What Is an Emergency Evacuation Plan and Why Is It a Legal Requirement?

An Emergency Evacuation Plan is a documented set of procedures that tells every person in a building exactly what to do, where to go, and who is responsible in the event of a fire or other emergency requiring evacuation. Under Section 11 of the Safety, Health and Welfare at Work Act 2005, every employer in Ireland is legally required to prepare and revise adequate emergency plans and procedures, and to provide the necessary measures for fire fighting and the evacuation of the workplace. 

The Fire Services Act 1981 and 2003 and the Safety, Health and Welfare at Work (General Application) Regulations 2007 further require that evacuation plans are clearly communicated to all persons in the building, regularly reviewed, and kept up to date. An inadequate or out-of-date evacuation plan is a serious compliance risk and can result in enforcement action by the local authority fire officer or the Health and Safety Authority (HSA).

The Housing (Standards for Rented Houses) Regulations 2019 — What Landlords Need to Know

Since 1 May 2019, all landlords and property management companies responsible for rented accommodation in multi-unit buildings in Ireland are legally required to comply with S.I. No. 137 of 2019 — the Housing (Standards for Rented Houses) Regulations 2019. Section 10 of these Regulations specifies that each self-contained apartment or house in a multi-unit building — defined as any building containing two or more homes sharing a common access — must contain:

  • A suitable mains-wired fire detection and alarm system
  • A fire blanket
  • An Emergency Evacuation Plan displayed within each unit
  • Emergency lighting in all common areas of the building

Enforcement of these standards is the responsibility of the relevant local authority, which carries out planned inspection programmes of rented properties across Ireland. Where a property is found to be non-compliant, the local authority can issue an Improvement Notice requiring the landlord to remedy the breach within a specified timeframe, followed by a Prohibition Notice preventing the property from being re-let until the breach is corrected. Landlords who fail to comply face prosecution in the District Court and fines of up to €5,000, imprisonment of up to 6 months, or both, plus a continuing daily fine of €400. Properties under the Housing Assistance Payment (HAP) scheme are subject to local authority inspection within the first 8 months of a tenancy.
